I don't get your question. The fact that it isn't a right under the federal constitution means that feds can regulate it to their hearts' content. See, e.g., en.wikipedia.org Wickard v. Filburn, where SCOTUS said the feds can prohibit farmers from growing their own wheat to feed heir livestock.

The fact that it is not a right means that the feds can regulate it. For instance, the feds can regulate pretty much anything they want under the commerce clause if SCOTUS feels like letting them do so. So the feds can say that we need more people, and prohibit abortion (just like they can say we need less wheat under Wickard and prohibit farmers from sowing their fields) under the commerce clause.
