This language seems purposefully vague. What do you mean by after arriving? Did he illegally cross the border and then file the claim? Or, did he go the official port of entry and file the claim before entering as is the required process?

If he crossed illegally and then they filed the claim later - boot his ass out.

So, the agents' seemed to know he was not the person they were looking for, but sent him to the El Salvador death prison anyway?

So, whether you enter the U.S. illegally (not at a sanctioned border control), or legally at a port of entry, you can still apply. The USCIS specifically states that you can, providing you adhere to one or both of these conditions:


You aren't in any removal proceedings
You follow the correct process and file within 1 year of entering the U.S.
