The schedule the justices set was not particularly speedy, though nothing prevents the special counsel from filing sooner than the court's Feb. 20 deadline ... Unless the justices move quickly, the trial could be pushed into the heart of the 2024 campaign, or even past the election.

"Last week, a three-judge panel of a federal appeals court in Washington unanimously rejected Trump's sweeping immunity claim. However, the judges agreed not to return the case to a lower court for trial until the Supreme Court acts on Trump's request for emergency relief.

Smith has already urged the courts to resolve the immunity dispute quickly so that Trump's Washington, D.C. trial, originally set for March 4, can begin later this year."

In December, the special counsel asked the Supreme Court to take up the immunity issue even before the D.C. Circuit Court of Appeals reviewed it, in order to reach an expedited conclusion, but the justices denied the attempt.

"This Court's immediate review of that question is the only way to achieve its timely and definitive resolution," Smith wrote in the December filing. "The Nation has a compelling interest in a decision on [Trump's] claim of immunity from these charges " and if they are to be tried, a resolution by conviction or acquittal, without undue delay."

Smith does not have to wait until next Tuesday to respond to Trump's latest high court filing, which was widely anticipated and largely repeats arguments his attorneys have raised previously."

The Court appears to be moving quickly by their standards. How often have you seen the Court take action on a matter within less than a day of it being filed? If they wanted to delay then they could have dragged their feet or just accepted the request for a stay. If they keep moving like this we could have an answer on the question by the end of this week.
Personally I feel they will quickly deny both the request for stay and the for cert. To overturn the lower court would be to put a bullseye on their own backs.
Trump's lawyer explained pretty clearly why there is a 0% chance of the ruling being reversed when he in effect said that granting the immunity claim would be the end of democracy in America because it would affirm that Biden or some future President could just cancel elections and order the deaths of any opposition.

I just want to point out that the relatively simple penalty phase of -------- (the fraud and sexual predator) fraud trial has lasted 4.5 months and is still not decided.

So, anyone who expects a criminal trial of this complexity to be resolved in 4 or 5 months is deluding themselves. I'd be surprised if jury selection was completed in that timeframe.
