Per the charging documents, AUSA Jeanine "Hic" Pirro could not prosecute Jan Carey for burning the American flag because an Executive Order is not a law. The word flag does not appear once in the Information: storage.courtlistener.com
Jan Carey served in the US Army from 1989 to 2012 and was deployed to Iraq and Afghanistan while Dummkopf Trumpf shirked his patriotic duty in Vietnam by evading the draft thanks to his father arranging a medical deferment over spurious "bone spurs."

Not to defend the tiny-fingered, ferret-wearing, cheeto-faced s--tgibbon here, but dodging the draft in Vietnam was actually the patriotic thing to do. We had no business being there.

One wonders if the principle that will emerge will be, burning a flag is free speech, but lighting a fire on federal property can be charged. But if it is free speech, that free speech right overpowers the point of creating a flame on public property, since no one was at risk.

#4: We had no business in Vietnam is right. Trumpf avoided the war not from patriotism, but a sense of uber-rich entitlement. That makes him an unprincipled hypocrite. The young men who fled to Canada to avoid Vietnam left their homes and families out of principle. No one can accuse them of being hypocrites.

Either way he wins. He prosecutes this veteran over legally protected free speech and if he loses, his moron base gets to go ape --- over the ruling and then he can whine about how unfair the courts are.
It's all bread and circuses at this point.
