"Trump took social media last month to declare that he was sending National Guard troops to "war-ravaged Portland," citing the need to protect immigration facilities there.

But the judge said Trump's determination about the purported chaos in Portland was "simply untethered to the facts," and said he likely exceeded his authority under the Constitution.

The judge also warned the Trump administration's actions risk blurring the line between civil and military rule.

"This country has a longstanding and foundational tradition of resistance to government overreach, especially in the form of military intrusion into civil affairs," Immergut wrote.

"This historical tradition boils down to a simple proposition: this is a nation of Constitutional law, not martial law. Defendants have made a range of arguments that, if accepted, risk blurring the line between civil and military federal power"to the detriment of this nation."

Reading some backgrounder, I learned Ike deployed the 101st Airborne to Arkansas when the local authorities refused to ensure security.

Whats different in this case? There's plenty of video of the ICE facilities getting attacked and blocked in. Either the Federal Government can enforce law or there is no Federal Government.

@#1 ... The judge also warned the Trump administration's actions risk blurring the line between civil and military rule. ...

That seems to be the operative rule in these cases.

But, imo, in the end, it will be up to SCOTUS to decide whether the military can police US citizens. ...

Maybe the federal government should follow the law when they enforce the law.

Then the protesters would have nothing to complain about?

Just a thought.

"Either the Federal Government can enforce law"

The military is not a law enforcement agency.

Give the man his Nobel Peace Prize

The prize will be announced on Friday so good bet it has already been decided. Might be time to play the "I wonder who will win" game.

NATO or the ICC would be fun ones. Pope Francis would be perfect but they never give it to Popes or dead guys.

I hope it's, 'the Palestinian NGO Women of the Sun and its Israeli counterpart Women Wage Peace', who are apparently nominated.

In 2020, Dumpy and his Confederacy of Dunces were posting about Portland "burning to the ground!!".

Now they're saying it again. I was there, helping a medical volunteer right across from the center of the protests. Other than a few garbage cans alit, nothing was ever 'burning to the ground'.

But I guess when you've thoroughly emeshed your minions with lies, a 149 square mile city burning to ashes twice in 5 years is nothing.

#16: Let's see how many ways the constables are named in other countries: "Policia, polizei, polis, police...."

These riot shields say "Policia," so clearly the photo was taken in either the US, UK, Canada, NZ, or Australia.
