Lindsey Halligan, President Donald Trump's handpicked interim US attorney for the Eastern District of Virginia, left her position at the Justice Department Tuesday, marking an end to her turbulent tenure bringing cases against the president's political enemies.

He was appointed by Garland as Special Prosecutor. The issue was Special Prosecutor is a creation of Congress. Congress didn't create a special prosecutor to prosecute the alleged crimes he was assigned.

Garland wanted his cake and wanted to eat it too. He wanted Trump to be prosecuted but wanted to make it appear as if it was independent and not driven by partisan politics. Once he was deemed illegitimate Garland could have assigned his two cases to a number of qualified prosecutors within 5 minutes and whoever he chose could have immediately brought Smith onto the team. The disruption would have been a mere blip in the process.

Halligan wasn't confirmed so she is simply not eligible.
