A federal judge has rejected X.AI's request for a temporary restraining order that would have halted enforcement of Minnesota's AI nudification ban. The bill was passed with near unanimous support in both the Minnesota House and Senate earlier this year. The law bans the use of technology that generates fake nude images of real people.

It's a hybrid of real and fake.

That scenario would be Chargeable because of the presence of an actual person's image.

Totally fake images are another thing altogether.

"AI material" is entirely based on everyone's real world data, placing moles and crooked teeth and whatnot from any source it sees fitting the "real world" it is generating from everyone.

AI generating real world scenarios requires oversight.

We don't have the AI input developed for that, just the porn.

You clearly do not understand what this law is about. The images targeted by this law are not private. They are being generated on a remote system and being transmitted over a public network. Many AI platforms permanently store the images that they generate. That video of the ten year old girl killed by a Russian bomb that prompted you to ask grok to recreate the pool scene from Fast Times only replacing Phoebe Cates with the bomb victim and you in place of Judge Reinhold is now Elon's property and he can show it to whoever he wants.

Earlier today, at the federal courthouse in Brooklyn, two criminal complaints were unsealed charging Cornelius Shannon and Arturo Hernandez with violations of the TAKE IT DOWN Act, which was enacted one year ago and prohibits the nonconsensual publication of AI-generated digital forgeries (deepfake) pornography. Shannon and Hernandez allegedly posted thousands of images and videos that appeared to depict real people nude and/or engaging in sexual acts. The victims included actresses, singers and political figures. Hernandez also posted hundreds of depictions of non-public figures appearing to engage in sexual acts. Hernandez was arrested today in Bedias, Texas, and will be arraigned in the Eastern District of New York at a later date. Shannon was arrested today in New Jersey and will appear this afternoon in Brooklyn before United States Magistrate Judge Peggy Cross-

Did you not read the article? It very clearly states "The law bans the use of technology that generates fake nude images of real people."

That said CSAM that appears to be true-to-life, whether it is a true depiction of actual children or has been created/edited by digital means, is illegal under federal law.

Yes, the media does not matter nor does it matter whether a real child is involved, Realistic visual depictions that is of, or appears to be of, minors engaging in sex or other obscene acts are generally illegal to produce, distribute, possess with intent to distribute or be the knowing recipient of is illegal under federal law.

If someone wrote a story about sex with kids could they be prosecuted even if it was never published or revealed. If it was discovered in a search or somehow came to light?

That's even more of an invasion of inner freedom.

I just see this as Overreach.

The pictures too, actually.

what part of "visual depiction" did you not understand?

And as to this hangup you have and "actual children", consider for a second what that would mean when it comes to prosecuting such cases.
If I'm a prosecutor handling a CSAM case then I'm going to have to locate the actual child depicted in the material and prove in court that they were a minor.
What about digital manipulation or AI? Does using Photoshop to change someone's hair color or skin tone mean that image is no longer a depiction of an actual person?
Is there a point that exists when a derivative stops being a depiction of actual people and becomes something totally unique and new?

I feel like what you suggest would make it nearly impossible to prosecute CSAM cases.
