I don't think she should have been fired, but I also think she should have politely accepted her nursing award and not force folks to listen to her ranting.

If she had to Shut Up to stay employed, especially, given that they were giving her an Award for Good Service, her First Amendment rights were being infringed.

She doesn't HAVE to Shut Up.

That's what rights are.

Otherwise they're just privileges that can be taken away at any time.

Firing her for that should be Illegal.

Also discrimination against specific ethnic groups, Muslims, Jews, etc. Is illegal under civil rights laws and so is retaliation for holding personal opinions about this.

To my mind, they were.

She had no reason to expect to be fired for speech that was not inflammatory.

These were personal observations made.

In The context of getting an award being given for presumably good performance.

She had been warned by her employer previously about making comments like this. It was not the first time.

Actually yes, I would feel the same. Up until open racism or abuse.

If the person is getting feted for good service and performance and they make a few political comments,even if the audience is offended I still don't think that's legal grounds for dismissal.

In bad taste maybe, not good form, but firing for that alone is too much, and if motivated by bias against the religion or creed of the person fired it is discrimination and illegal.

Unless she was under contract and that contract had stipulations regarding dismissal, you don't need legal grounds.

Just like she could have quit anytime she wanted to if the prevailing views within the hospital contradicted her own views.

I'm not sure about anyone else, but I'm at at-will employee. I am free to quit any time I want for any reason, while my employer is free to dismiss me at any time for any reason.

Which of her rights were violated? Be specific.

The first amendment does not apply to private employers.

She was warned several times by her HR dept to stay out of politics and not bring it into the workplace. She ignored the warnings and was blatantly belligerent about it.

She refused to comply with the directives of her employer. Her own actions are what got her fired.

Good luck with the lawsuit.
