I always thought it should be a short hearing: The defense lawyer should ask if Kelly, et al, would be in trouble if they made a video telling folks to FOLLOW illegal orders.

Once the prosecution answers yes, the defense asks for a dismissal.

Quick search: a federal grand jury has between 16-23 jurors, of whom at least 12 must vote in favor of the indictment for it to be issued (www.law.cornell.edu).

I am proud of our judges. At least most of them. The judicial system is standing in the way of Trumpy's tyranny.
