The state is arguing that Trump's use of one provision, which has never been invoked in this manner before, is illegal on numerous grounds.
Breaking news: California sued the Trump administration over its deployment of 2,000 California National Guard troops to Los Angeles, a move with little precedent that has dramatically increased tensions between the federal government and America's largest Democratic-led state.[image or embed]

Trump publicly acknowledge, during a 2020 town hall, that it would be against the law for him to unilaterally send in the National Guard to "stamp out rioters" without a governor's request or consent, unless he invoked the Insurrection Act, which he stated he was not doing[1][3][5].
In 2020, during an ABC News town hall, Donald Trump did state that he could not send the National Guard into Democratic-run cities without the request or consent of a state governor. Specifically, Trump said: "We have laws. We have to go by the laws. We can't move in the National Guard. I can call insurrection but there's no reason to ever do that, even in a Portland case. We can't call in the National Guard unless we're requested by a governor"[1][3].
Donald Trump has not invoked the Insurrection Act in 2025. While he has deployed National Guard troops to Los Angeles in response to protests and has made statements suggesting he is willing to consider broader executive actions, including the possibility of invoking the Insurrection Act, he has not actually done so as of June 9, 2025.

I have already stated this to Gaslighter: You don't need to invoke the Insurrection Act to do what Trump is doing. Newsom is an idiot, this much is clear.
Democrat state leaders have brought it on themselves with their acceptance of chaos and rioting as political expression.
President Trump exercised authority given to him by Congress as set forth in 10 U.S.C. Section 12406 " "National Guard in Federal service: call"
Whenever"
(1)the United States, or any of the Commonwealths or possessions, is invaded or is in danger of invasion by a foreign nation;
(2)there is a rebellion or danger of a rebellion against the authority of the Government of the United States; or
(3)the President is unable with the regular forces to execute the laws of the United States;
the President may call into Federal service members and units of the National Guard of any State in such numbers as he considers necessary to repel the invasion, suppress the rebellion, or execute those laws. Orders for these purposes shall be issued through the governors of the States or, in the case of the District of Columbia, through the commanding general of the National Guard of the District of Columbia.

The US Marines could be using non-lethal Active Denial Systems (ADS) on their fellow citizens. Some ADS use heat, others use sound: 4.-------------

This is also false, JFK used this (similar given the law has cahnged) provision many times during the civil rights era.
