"Federalizing the California National Guard is an abuse of the President's authority under the law " and not one we take lightly."

For a president to invoke this provision of the Armed Services Code, one of three conditions must be met. There must be an "Actual or threatened foreign invasion," an "Actual or threatened rebellion against the authority of the Government of the United States,'" or "the President is unable with the regular forces to execute the laws of the United States."

In addition, the law in question requires that "[o]rders" to National Guard members when this law is invoked "shall be issued through the governors of the States." Trump has not coordinated with or communicated any such orders to the governor's office at all, Newsom, a Democrat, said on Sunday.

"There's a protocol. There's a process. He didn't care about that," Newsom said on MSNBC.

The Pentagon is mobilizing 500 active-duty Marines to help reinforce the National Guard in response to protests in Los Angeles, a person familiar with the matter said.

A Defense Department official said the Marines based at the Marine Corps Air Ground Combat Center in Twentynine Palms, California were being mobilized. It's not clear when they would actually deploy to Los Angeles. CNN reported the mobilization earlier Monday.

In 2020, during an ABC News town hall, Donald Trump did state that he could not send the National Guard into Democratic-run cities without the request or consent of a state governor. Specifically, Trump said: "We have laws. We have to go by the laws. We can't move in the National Guard. I can call insurrection but there's no reason to ever do that, even in a Portland case. We can't call in the National Guard unless we're requested by a governor"[1][3].

Donald Trump has not invoked the Insurrection Act in 2025. While he has deployed National Guard troops to Los Angeles in response to protests and has made statements suggesting he is willing to consider broader executive actions, including the possibility of invoking the Insurrection Act, he has not actually done so as of June 9, 2025.

I have already stated this to Gaslighter: You don't need to invoke the Insurrection Act to do what Trump is doing. Newsom is an idiot, this much is clear.

Democrat state leaders have brought it on themselves with their acceptance of chaos and rioting as political expression.

Whenever"
(1)the United States, or any of the Commonwealths or possessions, is invaded or is in danger of invasion by a foreign nation;
(2)there is a rebellion or danger of a rebellion against the authority of the Government of the United States; or
(3)the President is unable with the regular forces to execute the laws of the United States;
the President may call into Federal service members and units of the National Guard of any State in such numbers as he considers necessary to repel the invasion, suppress the rebellion, or execute those laws. Orders for these purposes shall be issued through the governors of the States or, in the case of the District of Columbia, through the commanding general of the National Guard of the District of Columbia.

Here's the thing about those millions of "gallons of water" Trump mentioned there. First, by the time he did that, the fires were already out. Second, that water flooded the central valley, which is nowhere near where the fires were. Third, farmers in the central valley count on that water during the summer months when they face drought conditions. Fourth, when summer really gets going and the farmers need that water, crops will die and Trump will blame California for something he did -- see point three. Fifth, I don't guess it really matters all that much since there won't be workers to pick those crops.
