Drudge Retort: The Other Side of the News

Just before 1 a.m. Tuesday, the Biden Justice Department's hand-picked Trump prosecutor, Jack Smith, released a report on the investigation that resulted in the indictment of Donald Trump on four counts involving the 2020 election and the Jan. 6 Capitol riot. The report did not have a lot of new information in it " Smith has poured out his evidence in filing after filing for more than a year " but it did contain Smith's assessment that he could have convicted Trump had Trump not won the presidency and is thus no longer subject to federal prosecution. What else could Smith say? That he had spent all that time and money, and stirred up the country so much, on a case he thought he would lose? Of course Smith would express confidence. He had no other option. Now that he has quit, he leaves muttering, "I coulda won, I coulda won.

This caught my attention:

" In February 2024, Jack Goldsmith, a Harvard law professor who opposes Trump, wrote, "This rush violates Justice Department rules. The Supreme Court now faces the question whether it too will be a party to this rush and, if not, how it will avoid it." Goldsmith continued, "If this were any other defendant than Donald Trump, the rush to trial " which cannot possibly give the Trump legal team adequate time to prepare its defense " would be deemed wildly unfair. Smith's timing decisions clearly have a purpose of affecting' the presidential election, at least in the sense of wanting the American people to have the benefit of his evidence and the jury's verdict before voting in November."

It all backfired. All of it. None of this excuses Trump's deplorable and reckless speech and conduct on J6. Not in the slightest.

The problem is these prosecutions were so blatantly political and corrupt with their intent that it looks like they actually helped Trump because the middle saw it for what it was - a gross abuse of the legal system to try to influence an election. Ironically, by far the weakest case against Trump is the only one that completed the process.

Congrats, Democrats. Not only did your gambit fail big time but you've created a precedent for a quod pro quo retaliation. I hope that doesn't happen because it's counter productive but I won't shed a tear for Democrats being forced to play by their own rules.

... and the hush-money case was supposed to be the weakest of the three cases.

But 34 felony convictions later, even the weakest case was a win for Justice.

Or they knew they had no case.

Dementia does not absolve one of a crime. Folks with dementia can still be charged. The defense would then have to prove dementia. But claiming dementia can affect the sentence if convicted of that crime. But since no crime was committed there were no charges.

Meaning in MAGAnese that Biden was fully EXONERATED of any crimes.

I think you are mistaken. If memory serves when he went to SCOTUS to delay the penalty I think the majority used appeal as a reason for not granting a delay - follow the process.

The premise that Garland steamrolled Trump with Jack Smith's DOJ Investigation is, perhaps, the most ludicrous you may hear for the entirety of this new year.

It's more likely that Trump is only walking free is because he was let off the hook by Garland's tactics.

Ballhugger: the only similarity between the Biden document case and the Trump document case is that they involved classified documents. That's it.

Here is where they differ:

Biden case: Hey, these documents were discovered in my garage. I'm sorry, we have immediately seized control of them upon discovery, ads are turning them over as appropriate. There is no indication or evidence that there was a disclosure of those documents.

Trump case: unauthorized disclosure of classified documents is ON VIDEO during a press interview where the document was shown to a reporter and the documents were seen on the desk. The doj contacted the trump team: hey please turn those documents in, you're not dissed to have them. Did the trump team respond? No. They flat out just ignored the doj. The doj asked again for them to be turned in. Dis he respond? Again, no. He just flat out ignored the doj. So the doj was FORCED to go and take them back through a warrant. They have text messages and emails from the trump team that were turned over instructing employees to move the documents, hide them, and otherwise cover up their existence. The DOJ seized documents, and asked of that was all of them. The trump team LIED and said there were no more in their possession, when a few weeks later classified documents were again noted publicly on camera.

These two cases could not be more different. Trying to equate them is disingenuous at BEST.

The stupid line you're referencing was a backhanded slap by an investigator embarrassed he couldn't find a smoking gun.

The "claim" carries less weight than a fart in a windstorm.
