Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army, the Navy, the Marine Corps, the Air Force, or the Space Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both.

Technically the ruling isn't reading the Posse Act correctly, as in the exception by "Act of Congress", in this case the Insurrection Act.
I hereby call into Federal service members and units of the National Guard under 10 U.S.C. 12406 to temporarily protect ICE and other United States Government personnel who are performing Federal functions, including the enforcement of Federal law, and to protect Federal property, at locations where protests against these functions are occurring or are likely to occur based on current threat assessments and planned operations.

As I have previously argued, the NF Military, forces can't "execute the laws", only protect the government agents, assets that are used in executing the laws. The description in the ruling is clear, it was protection focused. Ergo ... I expect the it to be vacated by the current 3 9th circuit judges, and then taken up by the 9th circuit formally, I think its called a "limited en banc court" (LEBC)
