Probably Article 1 and Article 2.

Congress passed the ACA, which permits those "lawfully present" in the United States receive certain health-related benefits. The ACA also explicitly tasks HHS with fleshing out the ACA by issuing rules and regs, including eligibility criteria and defining "lawfully present."

DACA, in turn, permits certain persons who were brought here as children to avoid deportation from the United States and get renewable work permits in certain circumstances. HHS has decided that means those people are "lawfully present" as they are essentially exempt from the law that would preclude them from being present.

If you still feel this violates the Constitution, there is no shortage of rightwing recreational litigators, such as the lead balding fascist Stephen Miller, who would jump at the chance of making a spectacle of anything related to latin immigration. As usual, Republicans are mad that Biden did something that might actually help some random normal person.

For months I've been reporting in The Huffington Post that President Obama made a backroom deal last summer with the for-profit hospital lobby that he would make sure there would be no national public option in the final health reform legislation. I've been increasingly frustrated that except for an initial story last August in the New York Times, no major media outlet has picked up this important story and investigated further.

Hopefully, that's changing. On Monday, Ed Shultz interviewed New York Times Washington reporter David Kirkpatrick on his MSNBC TV show, and Kirkpatrick confirmed the existence of the deal. Shultz quoted Chip Kahn, chief lobbyist for the for-profit hospital industry on Kahn's confidence that the White House would honor the no public option deal, and Kirkpatrick responded:

To be DACA, you have to have been here since 2007, so other than a few 17 year olds DACA recipients are not children. The idea of the DACA program was to provide a path to citizenship for mostly young adults who were brought here by their parents, through no choice of their own. It was supposed to be a temporary solution, to provide legal status until permanent reforms could be made. it is a disgrace that hasn't happened yet.

I'm a bit confused as to the headline, and I just checked with a friend who is DACA. DACA recipients are ALREADY considered "lawfully present",that was the whole idea of the program. Therefore it seems there would be no need for Biden's "new federal rule" changing the definition of "lawfully present" in order for them to be eligible for Exchange Plans.

Probably I'm missing something.

They put a stay on the move to end DACA because the move didn't follow the administrative procedures act. Of course Obama admitted on over 20 prior occasions he lacked the power to enact something like DACA and didn't follow the administrative procedures act when enacting it and SC never affirmed it - SC simply struck down HOW Trump admin went about ending it.

It operates outside existing immigration law. The Obama admin simply legislated as if it was both Executive and Legislative branch.

This link goes into more depth explaining the "lawfully present" rule change. Apparently DACA folks, while generally considered "lawfully present" were specifically excluded from being considered lawfully present for the purpose of the ACA. The rule change removes that exclusion.

DACA is current day policy, rught now. HHS deals in reality, not your imaginary armchair legal analysis fantasyland.

If DACA recipients are here, and are functionally exempt from laws that forbid them from being present, it is not patently unreasonable to call them "lawfully present."

But not all dreamers are children " some are now adults after arriving in the United States at a young age. In Houston, paramedic Jesus Contreras, who came to the U.S. when he was six years old, credits DACA for allowing him to earn his paramedic certification at a community college.

Contreras said he's now worried he won't be able to work if he loses his DACA recipient status. Which, in turn, begs the question: how does the halt of DACA impact first responder hiring? Additionally, what does it mean for those who are already first responders, such as Contreras?
First responder hiring and DACA

Fully staffing police, fire and EMS departments can be a challenge. Adding in the DACA reversal, it may present issues from the top down.

While most police departments require U.S. citizenship, the ability to hire DACA recipients as law enforcement officers varies state by state, according to the Immigrant and Refugee Center.

"The law forbids many employers from discriminating based on different factors, including national origin. There are exceptions to this general rule, particularly when the work deals with issues of national security," the Immigrant and Refugee Center said. "Different states may also have enacted legislations that require U.S. Citizenship for law enforcement officers." ...
