More: The new case represents another twist in the department's tortured efforts to satisfy the demands of Mr. Trump to pursue criminal charges against Mr. Comey, a longtime target of the president's wrath. The first indictment against Mr. Comey was thrown out by a judge.
The charge stems from an incident nearly a year ago, when Mr. Comey, vacationing on the North Carolina coast, posted a photograph on social media showing seashells arranged to say "86 47," combining the slang term "86" often used to mean dismiss or remove in reference to Mr. Trump, the country's 47th president.

Try, try again.
You really gotta admire Donald Trump's, "throw ---- at the wall until something sticks" methodology.
Excellent use of taxpayer dollars.

"Excellent use of taxpayer dollars."
Well, it gives Republicans something to bitch about and pretend it was the other party's fault. Same with all the passports that are going to have to be replaced, the damage to the WH, and all the other desecrations.

I'm guessing about 6-8 weeks before this one is also dismissed.

Funny, I seem to remember certain posters puling about Trump being charged with actual criminal offenses as "lawfare" that have conveniently gone quiet on these clearly inappropriate uses of federal law enforcement.

Matt Gaetz insists his use of 86' is distinct' from Comey's threat' as MAGA accused of hypocrisy over term (May 2025) www.independent.co.uk
... MAGA world erupted in fury on Thursday night over a social media post from former FBI Director James Comey, claiming that his image of seashells spelling out the numbers "8647" constituted a "threat" on President Donald Trump's life. "He knew exactly what that meant. A child knows what that meant ... That meant assassination,'" Trump fumed in an interview with Fox News anchor Bret Baier on Friday. Yet, while the Trump administration is investigating Comey and members of the president's cabinet are even saying he "should be behind bars," many of the same people raging that this was a call for assassination had previously used the same term to refer to their political opponents " including Joe Biden. Matt Gaetz, the former GOP congressman and one-time attorney general nominee who now hosts a show on far-right network One America News, jumped aboard the outrage train over the Comey post. With Republicans and Trump officials falling over each other to express indignation over the ex-FBI director's image, Gaetz retweeted a letter from Rep. Andy Ogles "urging an immediate joint investigation" by the FBI and Secret Service into Comey. Meanwhile, just last year, Gaetz proudly tweeted that he'd "now 86'd" former Speaker of the House Kevin McCarthy, former Republican National Committee chairwoman Ronna McDaniel and Sen. Mitch McConnell from their leadership posts, adding that "better days are ahead for the Republican Party." ...

Canada Hates Trump @AntiTrumpCanada
6h So let me get this straight: in Trump's America, a guy can post a picture of seashells that spell out "8647" and get indicted for threatening, while a guy who fires a bullet in the head of a protester at point blank range gets a pass? What a ------ up country.

One wonders just how idiotic were those on the Grand Jury who allowed the indictment to stand. Hillary Clinton would probably have been President if not for Comey's thumb on the scales at the last minute, but still, he did not commit the crime of threatening the life of the President.

Doubtful even Trump's chosen justices would be inclined to 86 Watts v United States (1969) (supreme.justia.com). Thomas and Alito, sure, of course, in a New York minute. But the restc(Justice Kegs aside)? Probably not.

Um, having grown up in the hospitality business, I'll help with the definition of "86" in the context of a restaurant kitchen: "86" means, no more, we're out of that item, all have been sold, have the guest order something else, don't ask again...

"in the context of a restaurant kitchen: "86" means, no more, we're out of that item"
Exactly. It's not "get rid of that item", it's "that item is no longer on the menu".
I guess snowflakes gotta snowflake.

In NYC shops last century, "86-er" meant potential shoplifter or useless regular customer who never buys anything but takes up our time.

Were these before or after Comey's instagram photo? It seems interesting given what I think the Comey Indictment is about.
And more perhaps ..
The indictment had multiple charges. www.justice.gov
871(a) - threat 875(c) - forfeiture of proceeds
The way indicment appears to be framed as in the context of Comey's marketing for book "FDR Drive" which is about the line between free speech and criminal incitement, or on a First Amendment battle over "incitement". So its kind of comical, in fact he might have been motivated to do this for financial gain.
Similar to Amazon?
Context: Same day as 86image, at the beach, Comey had another image on Insta where he was reading his book "FDR drive".
Not sure of the legality of this all, but

So what else is interesting is the third photo ... from the Insta sequence ... which is a summary of the book:
"Garcia believes Buchanan went far beyond the protection of the first amendment when *he singled out his enemies by name* and *suggested "something should be done" about them*. His fans have obliged, killing or grievously, injuring some of his foes."
Is Comey's post a warning about Trump? Or is it Comey making a call to action?
Very interesting.
