He bears responsibility for his own actions. He was threatening others to a point where they feared for their lives. You bring up Ashli Babbitt. She was shot and killed due to her own actions, a perceived threat, and she didn't pose nearly the physical threat the Neely posed.
The chokehold was a restraint until police arrived. When he was subdued the chokehold was loosened. He had drugs in his system and was likely schizophrenic. He was still alive when police arrived. Penny fully cooperated with police. People who were on the train with him testified that he was a protector - a good Samaritan.
Neely belonged in a mental institution or in prison. His rap sheet is a mile long.
A prosecutor known for reducing charges and soft on bail threw the book at Penny. With the help of the judge he took a strange legal move trying to at least get a 4 year prison sentence for Penny and the jury still acquitted him.
