Lawyers for Davey Hearn, the Olympian accused of criminally damaging the Reflecting Pool, said in a new filing that a crucial witness testified the area was already damaged before Hearn touched the water They also requested access to all materials that led to his indictment.

The filing states that the the witness testified that the liner was already damaged and that the same repair the government is blaming on Hearn was already needed.

Donny's personal attorneys fka the DOJ just cannot catch a break.

... After the pool appeared to show issues following its renovation, Trump repeatedly claimed, without providing evidence, that vandals had cut a gash hundreds of feet long along the bottom.

But Pirro said in Friday's court filing said a "botched installation" was to blame.

Prosecutors had presented a grand jury in D.C. with "evidence that damage to the Reflecting Pool was caused by vandals" after receiving initial reports to that effect from the Department of the Interior and the U.S. Park Police, Pirro wrote.

But after that grand jury returned its indictment against Hearn, the Interior Department provided "additional documents" showing that the damage occurring in June was the "result of flawed installation by the contractor, Atlantic Industrial Coatings," Pirro said.

She also blamed "the rush to complete the project prior to events associated with the America 250 celebration in the weeks surrounding Independence Day 2026."

Asked for additional comment, the U.S. Attorney's Office for D.C. told CNBC, "The motion speaks for itself." ...

David Hearn, a us olympian and business owner, was only arrested and prosecuted in order to cover up for Trump's lie.
You don't actually do anything wrong in Trump's America for the dictator to target you.

I see that prosecutors are now dropping charges against the Olympian and saying it was an installation issue.

For everyone who says, well, justice prevailed, no harm no foul ... No. This was still a malicious prosecution attempt, a way to keep the culture wars going and intimidate Americans who know the truth about the slimeballs who work for Trump.

When are you MAGA fools gonna see the light? The guy is a complete fraud.

I'm sure that's true for the core deplorables, Zed. But I still think there are some people who just don't challenge the Trump narrative yet still aren't as inherently malicious as he is.
