President-elect Donald Trump said Wednesday that he will nominate Republican Rep. Matt Gaetz of Florida as U.S. attorney general. Gaetz has been the subject of a House Ethics Committee investigation into whether he engaged in sexual misconduct or illicit drug use. Asked by a HuffPost reporter whether Gaetz has the character to be attorney general, Rep. Mike Simpson, R-Idaho, replied, "Are you s--- me?"

Ideal choice for Pres-elect Trump, from his view, to make for the position.

Rep Gaetz has a grudge against the DoJ, so his goals are likely quite well aligned with those of Pres-elect Trump.

Competence for the position is secondary, as other nominees have shown.

A loyalty to Pres-elect Trump looks to be the main criterion.

IF Trump replaced the then AG with a nobody in the Dept who WOULD sign the Letter to States that they could (illegally) replace the State Certified Electors from the Voters with whomever they pleased that would vote for Trump instead.

There are laws passed by Congress

the President INTERPRETS the laws so he can implement them.

If the president incorrectly interprets the law, there are 2 constitutional actions to address the incorrect interpretation

Congress can pass a law clarifying the law

A party injured by the president's action can sue for compensation for their injury.

Again, if the president takes an action that does not injure someone that is not against the law. no injury no role for the court.

Republican AGs used MOHELA as the claimant. MOHELA did not agree to be part of the lawsuit. And in fact MOHELA was going to MAKE MONEY on student loan forgiveness.

Thus the AGs did not show the most basic requirement for a lawsuit-standing.

They did not have standing to sue, because there was no injury. There was nothing for the courts to comment on.

When the courts comment on something that is NOT AN INJURY they are legislating-by definition. They are taking it upon themselves to say this is what the president is required to do or not do. That is Congress' role full stop.

The Senate Judiciary Committee, which will be chaired by a Republican when the new Congress is seated in January, will conduct confirmation hearings for the nominee for attorney general.

I remember reading something at the time the charges were dropped that the woman who was 17 at the time
of her engagement with Gaetz wasn't cooperating and didn't want to testify against him, which they saw as a stumbling block to the case. We'll have to see if she coorperated with the House ethics committee's investigation and/or if they have other evidence without her testimony. The ethics committee was looking into other potential violations as well. It seems like they must have found something or why would Gaetz resign so aburptly in an attempt to keep the report from coming out?

The Feds didn't have jurisdiction unless their assistance was specifically requested by local law enforcement or its the threats were done through the US Postal system and even then it would be handled on a case by case basis, not a broad basis.

The threats were through email and mail. the threats were the responsibility of the federal government. IIRC the feds are in charge of phone threats, certainly if calls are made over state lines.

They were asked to provide assistance, the provided assistance, they found 6 cases that could be prosecuted, they referred those cases to the appropriate agencies for action.

This is actually an example of the federal government doing the right thing, correctly.
