Drudge Retort: The Other Side of the News
Monday, November 24, 2025

The Pentagon on Monday said that it was reviewing what it called "serious allegations of misconduct" against Sen. Mark Kelly of Arizona for making a video with five other Democratic lawmakers that urged members of the military to refuse to follow unlawful orders.

"Five of the six individuals in that video do not fall under @DeptofWar jurisdiction," Hegseth wrote." However, Mark Kelly (retired Navy Commander) is still subject to UCMJ " and he knows that."

UCMJ is the Uniform Code of Military Justice.

The Pentagon, in its own statement on X, said that a "thorough review of these allegations has been initiated to determine further actions, which may include recall to active duty for court-martial proceedings or administrative measures."

Trump's a petty little B, and his Henchmen are unAmerican... and apparently too stupid to know the difference between legal orders and illegal orders.

Given their performance, there is NO REASON for any service member to ''assume' that an order from these Fascists is automatically legal... they've proven otherwise.

This is Trump's desperation acting-out. Heavy handed oppression designed to intimidate rank-and-file service members but also Congress.

It come on the day when the first wave of Trump's dictatorial lawlessness has been strangled in its crib. Let's hope that this nastiness fares no better.

To recall the astronaut, USN Secretary John Cartwright Phelan would have to authorize the NCIS to investigate US Senator Mark Kelly (D-AZ) and then order the USN to recall him to active duty for UCMJ.

Rich fatcat John Phelan is a former investment company CEO who never spent a day in the military. He is there to funnel contracts to insiders for Dummkopf Trumpf's "Golden Fleet," so he will no doubt find a way to pursue this ridiculous persecution.

" same. The "seditious six," as Secretary Pete Hegseth called the lawmakers who appeared in that video, deserved to be mocked. It's not hard to envision how Trump might have made Kelly into a laughingstock. Instead, he's making him into a martyr.

If this is the sort of "retribution" the president previewed on the campaign trail last year, it's not going to deter his critics. Worse, it indicates to persuadable voters that Trump's priorities are profoundly misplaced at a time when the public is losing patience with his administration's failure to rein in consumer costs. And so far, the revenge tour has produced no scalps of objective consequence.

The whole enterprise has been a costly waste of time."

I think that sums it up nicely.

Posted by BellRinger at 2025-11-24 08:44 PM | Reply

Yes, the National Guard can make arrests, but under specific circumstances depending on who has command and the applicable laws, such as the Posse Comitatus Act. When under state control (e.g., activated by a governor), National Guard members can perform law enforcement duties and make arrests within that state. However, federalized National Guard troops (under presidential control) are restricted by the Posse Comitatus Act and can only arrest in situations where they are specifically authorized, such as by the Insurrection Act or if they are deputized by a law enforcement agency.
Under state control
A state governor can activate the National Guard to perform law enforcement duties, including making arrests.
This is an exception to the restrictions on military involvement in domestic law enforcement.
Examples include situations where National Guard troops are deployed to enforce state laws or respond to emergencies within their state.
Under federal control
The Posse Comitatus Act generally prohibits the use of federal military forces, including the National Guard, for domestic law enforcement.
Federalized National Guard troops are subject to this restriction and cannot make arrests unless a specific exception applies.
One exception is when the president invokes the Insurrection Act, which allows for the use of military forces for domestic law enforcement.
Another exception is if the troops are deputized by a state or federal law enforcement agency.
Even without the power to make full arrests, federalized troops can sometimes temporarily detain individuals until civilian law enforcement arrives to take custody.
The DC National Guard
The DC National Guard has a unique status because it can be controlled by the President as its commander-in-chief, and is not subject to the same federal restrictions as the rest of the National Guard.
Because of this, the DC National Guard is authorized to perform law enforcement duties like traffic control, crowd management, and making arrests, and can also temporarily detain individuals until federal, state, or city law enforcement arrives.

From Alexandrite's link:

" The injunction was granted, blocking Trump from "deploying or requesting the deployment of any members of the National Guard to the District of Columbia;" however, the order is stayed for 21 days while the ruling faces an appeal. This means that the current deployment will remain in effect until at least Dec. 11"

If this gets shot down on appeal I'll gladly acknowledge Alexandrite's argument. Given how many lower court rulings against Trump that have been overturned on appeal ... I'll wait for the appeal ruling.

From JPW's Reuters link:

So, if troops are protecting a federal building (federal buildings were repeatedly targeted in 2020) according to JPW they can't do anything. If a couple of guys start helping Molotov cocktails at them and the building they have been tasked with protecting, they just have to stand there and do nothing. You were "mortified " at Trumpy's violations of the US Constitution by sending American troops into LA against the wishes of LA and the Governor of California in order to incite more violence?

Me too!

" Yawn. As usual, you swallow everything they give you and go back for more.

welcomed measures taken to prevent that from happening.

So you admit it.

You enjoyed seeing Trumpy abuse the power of his office (which does not belong to him) by sending American troops to harass them liberals in LA. You want to see him harass them everywhere.

Because that's the kind of American you are. (Assuming you are an American which is not a given anymore)

This is just another act of revenge and retribution that will backfire miserably and be another humiliation for the worst president ever.

A humiliation that will quickly be forgotten and overcome by the next embarrassing and humiliating act coming from Trumpy and his minions of hate.

STFU, loser. Summer 2020 was just over 5 years ago. You probably tugged away to all of the violence..
#78 | Posted by BellRinger

As with the police that murdered George Floyd, most of the violence that summer was instigated by the police.

During the Floyd disturbances, it was evident that nihilists and right-wing operatives were responsible for much of the violence.

This was my fear during the No Kings protests, that these people would would show up again. But also that rogue police elements such as ICE (don't bother arguing that they are not a uniformed gang) would provoke someone.

As things turned out, I was proud that the millions were able to exert such discipline over themselves and NOT GIVE TRUMP an opening, which he was obviously salviating over at the time.

No, JeffJ.

As is all too often the case, you are the liar.

The assertion that most of the violence in the 2020 civil rights protests was instigated by the police is supported by multiple analyses of the events. Research indicates that law enforcement responses often escalated tensions, with police using excessive force such as tear gas, rubber bullets, and batons against largely peaceful demonstrators.
A study by the Armed Conflict Location and Event Data Project (ACLED) found that over 93% of Black Lives Matter protests during the summer of 2020 were peaceful, with violence being instigated by protesters, counter-protesters, or police, and police sometimes escalating confrontations.
Reports from Amnesty International documented 125 instances of police violence against protesters across 40 states and Washington, D.C., between May 26 and June 5, 2020, including beatings, misuse of tear gas, and the inappropriate firing of less-lethal projectiles.
Furthermore, a 2025 study published in Criminology found that police behavior was disproportionately escalated during Black Lives Matter (BLM) protests compared to other movements, with instances of "egregiously overwrought" responses to peaceful protests and "restrained" behavior in the face of dangerous actions during other protests, suggesting animus against the BLM movement.
These findings indicate that while violence did occur, it was not primarily initiated by protesters, and police actions frequently contributed to or instigated violent escalations.

Take responsibility for being upset that a repeat of summer 2020 was stopped / never got sufficiently going.
