" the president's son lied on a mandatory gun-purchase form by saying he was not illegally using or addicted to drugs".

And what percent of current gun owners would also qualify? Remember folks, marijuana is still illegal federally, so any use is considered abuse.

He's 54,years old with no priors. Sentencing guidelines for this do not require, but do allow for prison time. My guess is he will not spend any time behind bars and will probably get 2-3 years of probation.

Hunter's words after the conviction were wonderful. All his loved ones were there with him, except for the President, who once again said his love for his son is boundless.

Then there's Trump.

Recently, federal appeals courts have held that the firearm possession
prohibitions for three of the nine categories violate the Second Amendment: (1) in Daniels, the Fifth
Circuit held that Section 922(g)(3) was unconstitutional as applied to the defendant; (2) in United States v.
Rahimi, the Fifth Circuit invalidated 18 U.S.C. 922(g)(8), which prohibits individuals subject to certain
domestic violence restraining orders from possessing firearms; and (3) in Range v. Attorney General, the
Third Circuit concluded that 18 U.S.C. 922(g)(1), which makes it unlawful for felons to possess
firearms, was unconstitutional as applied to a defendant whose past felony was a nonviolent fraud
offense.
Each of these three decisions"Daniels, Rahimi, and Range"is now before the Supreme Court in some
form.

SCOTUS ruled three of the nine restrictions as unconstitutional.

One would exonerate Hunter.

Another, allow Trump to arm himself:

Third Circuit concluded that 18 U.S.C. 922(g)(1), which makes it unlawful for felons to possess firearms, was unconstitutional as applied to a defendant whose past felony was a nonviolent fraud offense.

Weiss sat on serious allegations to allow for the statute of limitations to kick in. Weiss then worked up a plea deal where this case never would have seen a courtroom until the presiding judge began asking questions and found the nuts and bolts of the plea deal to be so ridiculous that she wouldn't allow it to stand. It will be interesting to see what the 3rd circuit appeals court rules on this (assuming there will be an appeal). Will they go the way of the 5th and declare the law violates 2A or will they uphold the ruling and setup an appeal to SCOTUS.

That would create some interesting political irony with this radical far right SCOTUS tossing the conviction of someone who has been demonized by the far right while at the same time the case of US v Biden would result in overturning an important gun control measure after Joe Biden has fought for decades to expand gun control.

President Joe Biden expressed respect for both the judicial process and his son Hunter Biden after a Delaware jury found him guilty Tuesday on three counts of illegally possessing a gun amid his struggles with addiction nearly six years ago.

Hunter Biden, who has spoken about his problems with substance abuse at length, is now facing potential prison time following the verdict.

"As I said last week, I am the President, but I am also a Dad. Jill and I love our son, and we are so proud of the man he is today," President Biden said in a statement.

"So many families who have had loved ones battle addiction understand the feeling of pride seeing someone you love come out the other side and be so strong and resilient in recovery. As I also said last week, I will accept the outcome of this case and will continue to respect the judicial process as Hunter considers an appeal," he went on.

Fact Checking Jeff again

The plea deal was tossed because there was a disagreement between the Prosecution and Defense over what charges it covered.

The deal was NEVER rejected by the Judge. The Judge had an issue with the structuring. Then hearing was rescheduled and the deal was dropped before the second hearing.

FTA:

there were only three explanations for the purported turnabout. Number one is essentially incompetence: Prosecutors didn't understand the implications of what they were promising. Number two is malfeasance: Prosecutors knew all along they were offering something more limited, but misled Hunter's attorneys about what they meant. Number three is flip-flopping: Prosecutors initially made the broad promise, but reneged after political backlash from Republicans.
Sounds about right.

It will be interesting to see what the 3rd circuit appeals court rules on this (assuming there will be an appeal). Will they go the way of the 5th and declare the law violates 2A or will they uphold the ruling and setup an appeal to SCOTUS.

SCOTUS invited this calamity by inventing a completely unworkable standard in Bruen. It formally tasks judges with being historians, and is one of the most lawless exercises the Court has ever embarked upon.

The real crime is receiving millions from energy companies in Ukraine, China, and Romania. He's not being prosecuted for any of that, since it would inculpate The Big Guy. Instead, Dems can claim this as proof that the justice system is not weaponized against conservatives. Hunter will get a year or two of probation requiring a monthly zoom call and no drug testing.

I'm not mad about it. Both sides use the tools at their disposal to get away with all kinds of shady dealings. It's just sad that liberals refuse to believe in any way that anyone in their party can do bad things. Like parents who always say, "My kid would never do that". The problem isn't Hunter, it's the voters who continue to let Dems get free passes for everything shady.

If Hunter gets any prison time he should have his sentence commuted if not flat out pardoned. As Trey Gowdy(Fox News host) said about Hunter Biden and these charges: I did gun prosecutions for six years. I went after convicted felons, I went after people who were fugitives from justice. I went after lots of different people who are prohibited from possessing a firearm. But, I bet you there weren't ten cases prosecuted nationwide of addicts or unlawful drug users who possessed firearms or lied on applications. I bet there weren't a dozen. Which makes you wonder, of all the cases you could be pursuing in Delaware, why are you pursuing this one?

Gotta love the effort Gowdy goes to resolve that cognitive dissonance of "these charges are bullshht" but "Biden" soooo... "there just has to be worse things!"

It does make me laugh.

Danforth,

Let me put it another way.

At 54 years old Hunter Biden has zero priors (that may well change but let's deal in the present). In this particular case his crimes had zero victims of any kind, violent or nonviolent.

The case itself was a straightforward slam-dunk. Nevertheless, I would expect sentencing leniency here and in the absence of that I would expect Joe Biden to pardon his son, or at least commute his sentence.

I understand the argument that were he to do so it would be an abuse of pardon power. Okay. Does it rise to the level of impeachment? I argue that it doesn't.

I hope that clarifies where I'm at with this.

So, on a Venn Diagram - "you know, like a Venn Diagram *waves arms around in a circle and cackles* - and you are STILL pissed off that we are only MOSTLY aligned on this.

The Hunter indictments clearly spelled out the crimes he was accused of - can't say that of the Bragg indictments. But that's beside the point.

It is ridiculous that you are all up in arms over me saying I won't have an issue if Biden issues a pardon (or commutation - there is a difference and it's one you should be more careful of when you bring up Trump "pardons") because the Constitution enumerates that power to him as the result of the outcome of the 2020 election.

This isn't about BAIT. It's about you being a lying sack of schittt.

It's about the fact you claim you could name "plenty", and when challenged you always run away. Or in this case, proffer the lamest of lame excuses.

The fact is you've been asked again and again, and can't even name ONE, and never have, despite dozens of requests.

Last chance. Either point out an indictment of Trump's which you or I could do without fear of legal repercussions, or admit you can't.

Until people like yourself show even the least bit of concern about a President whose hand-picked DOJ leaders had to threaten mass resignation to stop him from appointing one of his loyalists in the Dept to send an official letter to States approving Fake Ballots...

... and even then carried out his scheme with Fake Electors instead and an angry mob to for the first time in our history violently threaten the peaceful transfer of power in this country... all when he knew had lost the Election; all this sworn under Oath by his own lawyers, aides, and appointees...

... until then, your crocodile tears over his being brought to justice in a State criminal case under statutes that have been similarly used almost 10k times, and that will see full appeals, are not at all interesting in the least.

And you continue your history here of looking most pathetically the fool with every word you type.

3 since he was not charged with the underlying crime it does not have to be specified. --The accusation is proof of the crime, which doesn't need to be specified.
4 the prosecutor offered 4 underlying crimes in pre trial motions. The judge allowed 3 of the 4 to be considered. --That was white of them, since it's all made up anyway.
5 he did not have to have committed the underlying crime he could have been hiding cohen's crimes which cohen was found guilty of. --The Soviet Union legal system had more protection from abuse.
6 the prosecutor laid out the potential underlying crimes in their opening statement and provided evidence in the trial. --We don't have to prove that the crimes existed for Trump to have been guilty of the crime of hiding them.

Trump received invoices for legal services. Somehow each invoice is a felony for Trump?
Trump paid the invoices with checks that had "legal services" in the memo field. Each check was a separate felony?

1 ------- falsified documents to hide tax evasion, and/or break ny state election laws and/or break campaign finance laws. The intent to do this was all that is necessary to break the law. Which he knowingly did
2 the underlying crimes were spelled out and proven through testimony and hard evidence sufficient to convince 12 people beyond a reasonable doubt
3 the underlying crime was not charged nor was it required to be charged thus not in the indictment (that is basic legal stuff). They were presented during the case. You clearly are ignorant of the law
4 it was not made up it was proven in court but it is nice to see you refute your own argon 1-3 above about them not being presented. Almost like you are being disingenuous
5 good to see you hate America
6 only an idiot would claim that the crime doesn't exist when -------'s coconspirator was found guilty of them

They became felonies due ti he falsifying the documents to hide other crimes
Something prosecuted 10000 times

Btw what you fail to acknowledge is that the crimes had a huge impact as it is arguable that had he not committed them he would have lost the election as the affairs with a porn star would have come out right before a very tight election

Do you? Or just in this case? "drug users" covers a lot of ground.

Should Bill Maher go to prison? He's admitted he has a gun and he certainly smokes a lot of pot.

Does Willie Nelson have a gun? I have no clue.

"The government is prosecuting on gun offenses"

...which never get brought unless the person uses the gun in furtherance of other crimes. Or their last name is Biden.

Trey Gowdy said he hadn't heard of 10, ABC News couldn't find a single one, and other prosecutors said they'd NEVER bring a charge like this.

But if gun owners can be arrested for drugs, I'm all for it. For example, anyone who believes gun-owner DJTJ isn't on drugs is a total moron.

How about a mandatory piss test/follicle analysis annually for gun owners? Anyone who pisses dirty gets a felony charge.

Fair enough?

#222 | Posted by Danforth at 2024-06-12 10:59 PM | Reply

Again, do you want the government going after drug users purchasing guns or not? Because it's either let everyone who uses drugs have guns or the government needs to prosecute more people (and by extension would further limit guns on the streets).

#223 | Posted by Bluewaffles at 2024-06-12 11:37 PM | Reply

"do you want the government going after drug users purchasing guns or not?"

Sure. Annual piss test or annual follicle test?

"it's either let everyone who uses drugs have guns or the government needs to prosecute "

There's probably a sensible third option in there, somewhere.

But we've set the precedent, haven't we? ANY gun owner using drugs needs to turn their gun in to the authorities, or face felony charges.
